  • April Launch of the Chemical Policy Review +

    Launch the Chemicals Policy Review (CPR) due to the failure of the Existing Substances Regulation by the European Environment Council which called on the Commission to: «develop a new, integrated and coherent chemicals policy adequately reflecting the precautionary principle and the principle of sustainability and specifying the obligations incumbent on the parties involved».

2007

  • JUNE 1 REACH comes into force +

    REACH is the new EU regulation concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals. The EU legislators finalised the process of creating this new chemicals policy for Europe in December 2006, thus marking a historic milestone. REACH will revise completely the existing legislation on chemicals.

    REACH is officially entering into force on 1 June 2007.

    It requires manufacturers and importers of chemicals to register each substance they make or place on the market in quantities exceeding one tonne in a central database managed by the European Chemicals Agency (ECHA).

    The aim of REACH is to ensure the protection of human health and environment, maintain the competitiveness of the European chemical industry and prevent the fragmentation of the internal market. This regulation is applicable in the same way across the 27 Member States of the European Union.

    Appe is thoroughly committed to safer products and processes and is assisting the petrochemical industry and downstream users with respect to the implementation and compliance with the REACH legislative framework and is working on the creation of consortia for its sector groups in order to prepare for the registration of petrochemistry-related substances. These consortia will facilitate the exchange of information on hazards, handling and use of substances and allow substantial savings of testing and registration costs.

    Participation in a consortium is voluntary and open to non-members of the respective sector groups, who have declared their interest to join the respective sector groups.

2008

  • JUNE 1 Pre-registration starts for existing "phase-in" substances +

    Pre-registrations will start on 1 June 2008 and need to be submitted to the European Chemicals Agency no later 1 December 2008.

    Whilst Companies need to pre-register and notify accordingly the EU Chemical Agency by 1 December 2008, it is important to bear in mind that there are different deadlines for the registration:

    • Manufacturers/importers supplying a substance above 1,000 tonnes/year, or a CMR cat. 1 or 2 substances above 1 tonne/year, or an R50-53 substance (PBT/vPvB) above 100 tonnes/year: 1 December 2010
    • Manufacturers/importers supplying a substance above 100 tonnes/year: 1 June 2013

    Manufacturers/importers supplying a substance above 1 tonne/year: 1 June 2018

    Progess on Appe consortia formation: (link to respective consortium template)

    The role of Appe and its sector groups is strictly limited to facilitating the formation of consortia with an interest with the substances under the umbrella of Appe.

    Aromatics & Lower Olefins REACH Consortium: Both APA and LOSG have agreed on the structure of a joint consortium to prepare registration dossiers for REACH. LOA-Team has been appointed as the service provider to handle the registration of +/- 200 dossiers for 20 categories of substances. The draft consortium agreement needs to be finalized. The launch of the consortium is scheduled before the Summer. Non-member companies will also be invited to joint.

    • Amines REACH Consortium: The member companies have signed a preliminary agreement to form a consortium, which should be in place by June 2008. They are currently working on the finalisation of the consortia contracts and all technical committees are progressing with the data gap analysis against the REACH annexes VII & VIII. Needs and procedures for technical and secretarial subcontracting are being defined.
    • Acetyls REACH Consortium: The member companies have signed a preliminary agreement to form a consortium, which should be in place by June 2008. They are currently working on the finalisation of the consortia contracts and all technical committees are progressing with the data gap analysis against the REACH annexes VII & VIII. Needs and procedures for technical and secretarial subcontracting are being defined.
    • Alkylamines & Derivatives REACH Consortium: The member companies have signed a preliminary agreement to form a consortium, which should be in place by June 2008. They are currently working on the finalisation of the consortia contracts and all technical committees are progressing with the data gap analysis against the REACH annexes VII & VIII. Needs and procedures for technical and secretarial subcontracting are being defined.
    • BDO & Derivatives Consortium: The member companies have signed a preliminary agreement to form a consortium, which should be in place by June 2008. They are currently working on the finalisation of the consortia contracts and all technical committees are progressing with the data gap analysis against the REACH annexes VII & VIII. Needs and procedures for technical and secretarial subcontracting are being defined.
    • Methanol REACH Consortium: The member companies have signed a preliminary agreement to form a consortium, which should be in place by June 2008. They are currently working on the finalisation of the consortia contracts and all technical committees are progressing with the data gap analysis against the REACH annexes VII & VIII. Needs and procedures for technical and secretarial subcontracting are being defined.
    • Ethylene Oxide & Glycol REACH Consortium: All member companies have signed a REACH Consortium Agreement covering the registration activities pertaining to ethylene oxide and the five basic ethylene glycols. BASF has been nominated as Lead Company. The real dossier preparation work has start after the May inaugural meeting.
    • Fuel Ether REACH Consortium: This Consortium has been created by the EFOA Members and is open to all ether producers and importers, including non-EFOA members). They have finalized the It the consortium and cost sharing agreement and a Technical Task Force has been formed to handle the technical aspects of preparing the REACH dossier and Chemical Safety Report (CSR). TNO was appointed as the service provider and ReachCentrum as the project manager. The lead registration is LyondellBasell.
    • Solvents REACH Consortium: Solvent producers part of OSPA (Oxygenated Solvent Producers Association) and HSPA (Hydrocarbon Solvent Producers Association) have appointed …. As the service provider for solvents.
    • Acrylonitrile REACH Consortium: Selection of service provider and finalization of agreement ongoing.
    • Phenol REACH Consortium: Fraunhoffer Institute was appointed as service provider and the agreement is in its finalisation stage.
    • Coal Tar REACH Consortium: The consortium has been formed, and their data are ready for pre-registration.
    • MMA REACH Consortium: The member-companies of the Methacrylate sector group have appointed a service provider in the USA.
    • Phenol REACH Consortium: The data gap analysis is ready for the Consortium to considered upon proper set-up.
    • Ethyl-Benzene REACH Consortium:
    • Styrene REACH Consortium: McKenna has been appointed as the service provider for styrene. The agreement is in its finalisation stage and the Consortium is expected to be launched in June 2008.
  • DECEMBER Pre-registration ends for existing "phase-in" substances and registration starts for existing substances not pre-registered +

    REACH requires manufacturers and importers of chemical substances (larger than or equal to 1 tonne/year) to obtain information on the physicochemical, health and environmental properties of their substances and use it to determine how these substances can be used safely. Each manufacturer and importer must submit a registration dossier documenting the data and assessments to the Agency.

    The list of pre-registered substances (2.2 mio) will soon be made available by ECHA. This will coincide with the next phase of the REACH process in which firms making or importing the same chemical will share data in substance information exchange fora (SIEF), which will prepare the registration dossiers according to the volume bands foreseen by REACH.

    The Cefic/REACH Industry Preparation Letter No 10 provides guidance to Cefic member companies on the obligations and practicalities of assessing data requirements, the sharing of data, associated costs and joint submission.

2009

  • JANUARY Pre-registered list of substances published and SIEFs formed +

    As of 1 January 2009 the Chemical Agency will publish the list of the pre-registered substances and all manufacturers/importers who notified their intention to register the same substance will participate in the Substance Information Exchange Forum (SIEF). The Cefic/REACH Industry Preparation Letter No 10 provides guidance to Cefic member companies through the key REACH challenges in 2008 and early 2009 including pre-registration, SIEF and data-sharing.

    The final text of the Classification, Labelling and Packaging regulation including new rules complementing REACH through the implementation a globally harmonised system (GHS) in the EU is now available.

    The Cefic model SIEF agreement providing a contractual framework for the SIEF is now available.

  • JUNE 1 First recommendation of priority substances considered for authorisation by ECHA +

    Cefic guide decribing the Exposure scenarios for preparations is now available. This comes along with a methodology for the identification of substances that represent the dominant risks to human health and/or the environment and the drivers for risk management measures.
